Terms of Use.
The terms that govern your access to and use of the LightFeather website.
Contents
These Terms of Use govern your access to and use of lightfeather.io and related LightFeather web surfaces. Please read them carefully. By using the Site, you agree to them.
Acceptance of these terms.
These Terms of Use (“Terms”) are a binding agreement between you and LIGHTFEATHER IO LLC (“LightFeather,” “we,” “us,” or “our”). By accessing or using lightfeather.io and any web surface that links to these Terms (the “Site”), you agree to be bound by them and by our Privacy Policy. If you do not agree, do not use the Site.
Changes to the terms.
We may update these Terms at any time. Changes are effective when posted, as reflected in the “Effective date” above. Your continued use of the Site after a change means you accept the revised Terms.
Use of the site.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for lawful, informational, and business-evaluation purposes. You agree not to:
- Use the Site in violation of any applicable law or regulation;
- Copy, reproduce, distribute, or create derivative works from Site content except as expressly permitted;
- Attempt to gain unauthorized access to the Site, its systems, or networks, or interfere with their operation or security;
- Use automated means to scrape, harvest, or collect data from the Site without our prior written consent; or
- Introduce malware or engage in any activity that disrupts or damages the Site or other users.
Intellectual property.
The Site and its content (including text, graphics, logos, images, layout, and code) are owned by LightFeather or its licensors and are protected by U.S. and international intellectual-property laws. Except for the limited license above, no rights are granted to you.
Trademarks, certifications, and program marks.
“LightFeather,” the LightFeather logo, and related names and marks are trademarks of LightFeather. You may not use them without our prior written permission.
The Site may also display third-party certification marks and the names or marks of Government procurement programs: for example, the Service-Disabled Veteran-Owned Small Business (SDVOSB), Veteran-Owned Small Business (VOSB), and Women-Owned Small Business (WOSB) certification marks; the ISO 9001:2015 certification mark; and the names or marks of contract vehicles such as the GSA Multiple Award Schedule (MAS), NASA SEWP, GSA Polaris, and Navy SeaPort. These marks are the property of their respective owners and are displayed solely to identify LightFeather’s certifications and the procurement vehicles through which our services are available.
The display of any certification mark, program name, agency seal, or Government logo does not imply that the certifying body, the U.S. Government, or any agency endorses, sponsors, or is affiliated with LightFeather, its services, or this Site. We use such marks only where authorized and in accordance with each owner’s applicable usage guidelines, and we do not alter them.
No government endorsement.
References on the Site to government agencies, programs, contracts, or past performance are provided for informational purposes only. They do not constitute or imply endorsement, recommendation, or favoring by the United States Government or any agency thereof. Any views expressed on the Site are those of LightFeather and do not reflect the official position of any government agency.
No offer; informational content.
Content on the Site is provided for general informational purposes and does not constitute professional, legal, or technical advice, nor an offer, solicitation, or commitment to provide services or enter into any contract. Any engagement with LightFeather is governed by a separate written agreement. Statements about future plans or capabilities are forward-looking and not guarantees of results.
Your submissions.
If you send us information through the Site, such as an inquiry, feedback, or an employment application, you represent that it is accurate and that you have the right to provide it. Do not submit confidential, proprietary, classified, or controlled government information through the Site. Except for personal information governed by our Privacy Policy, we may use feedback and suggestions you provide without restriction or obligation to you.
Third-party links.
The Site may contain links to third-party sites and resources. We provide these for convenience only and do not endorse or assume responsibility for their content, products, or practices. Your use of third-party sites is at your own risk and subject to their terms.
Disclaimers.
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ITS CONTENT IS ACCURATE OR CURRENT.
Limitation of liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, LIGHTFEATHER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
Indemnification.
You agree to indemnify and hold harmless LightFeather and its affiliates and their respective officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms or applicable law.
Governing law and disputes.
LightFeather is incorporated in the State of Delaware with its principal place of business in the Commonwealth of Virginia. These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in the Commonwealth of Virginia, and you consent to their jurisdiction and venue. Nothing in these Terms limits any rights of, or remedies available to, the United States Government.
General terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and LightFeather regarding the Site. You may not assign these Terms without our consent; we may assign them freely.
